The NCAT process — what to expect

  1. File online or in person — Applications lodged at onlineregistry.lawlink.nsw.gov.au or any NCAT registry
  2. NCAT serves the respondent — NCAT sends the respondent a notice with the hearing date
  3. Hearing scheduled — Typically 4–8 weeks after filing for Consumer and Commercial matters
  4. Hearing — Informal process before a Tribunal Member; both parties present evidence and argument
  5. Decision — Made on the day or reserved; orders are enforceable as Magistrates Court judgments

Do you need a lawyer at NCAT?

No. NCAT is specifically designed for self-represented parties. Legal representation in the Consumer and Commercial Division is restricted for claims under $30,000 and requires leave from the Tribunal. A well-prepared application with clear evidence is more important than a lawyer.

Before filing — letter of demand required
