Common questions
Does a cease and desist have legal weight? It is not a court order and has no legal force by itself. It puts them on formal notice, sets a deadline and creates a record you can rely on if you take it further.
Can I get a restraining order if they ignore it?If the behaviour continues after a cease and desist, you can apply for an injunction or protection order through the courts.
What if I'm being defamed online? Each state and territory has its own defamation law (a Defamation Act in each state and the Northern Territory; Chapter 9 of the Civil Law (Wrongs) Act 2002 in the Australian Capital Territory). In every state and territory except Western Australia, a concerns notice must be given before defamation proceedings can start, so our Defamation Concerns Notice service may suit you better. Our Programmatic Algorithms will identify the specific provisions that apply to your situation and draft a letter accordingly.
