Everything About Unpaid Wages Demand
Is wage theft really a crime now?
Yes, when it is intentional. Since 1 January 2025, an employer who intentionally underpays wages or other entitlements commits a criminal offence under s 327A of the Fair Work Act; an honest mistake is not a crime, but the money is still owed. Individuals face up to 10 years imprisonment. Companies face fines of up to three times the underpayment or 25,000 penalty units, whichever is greater.
Can I send this while I'm still employed?
Yes. It's illegal for your employer to take adverse action against you for exercising a workplace right, including making a complaint about underpayment.
How do I know if I'm being underpaid?
Check the Fair Work Ombudsman's Pay Calculator (calculate.fairwork.gov.au) to find your minimum pay rate under your Modern Award.
What if my employer says I'm a contractor?
If your employer controls how, when, and where you work, you may be an employee regardless of what they call you. Sham contracting is illegal.
Can I have a Unpaid Wages Demand drafted for me instead of writing it myself?
