Common questions
How long do I have to lodge? You must lodge your application within 21 days of the dismissal taking effect. This deadline is strict — the Fair Work Commission accepts a late application only if it is satisfied there are exceptional circumstances (Fair Work Act s 394(3)). Don't wait.
What can I get if I win?The Fair Work Commission can order reinstatement (getting your job back) or compensation of up to 26 weeks' pay (capped at half the high income threshold).
Am I eligible to apply? You're protected if you work for a national system employer, you were employed for at least 6 months (or 12 months for a small business with fewer than 15 employees), and either an award or enterprise agreement covers you or you earn less than the high income threshold ($190,100 from 1 July 2026). You only need one of those last two, not both (Fair Work Act s 382).
