Everything About Unfair Dismissal Application
How long do I have to lodge?
You must lodge your application within 21 days of the dismissal taking effect. This deadline is strict — the Fair Work Commission accepts a late application only if it is satisfied there are exceptional circumstances (Fair Work Act s 394(3)). Don't wait.
What can I get if I win?
The Fair Work Commission can order reinstatement (getting your job back) or compensation of up to 26 weeks' pay (capped at half the high income threshold).
Am I eligible to apply?
You're protected if you work for a national system employer, you were employed for at least 6 months (or 12 months for a small business with fewer than 15 employees), and either an award or enterprise agreement covers you or you earn less than the high income threshold ($190,100 from 1 July 2026). You only need one of those last two, not both (Fair Work Act s 382).
What if I was a casual?
Casual employees can apply if they were engaged on a regular and systematic basis and had a reasonable expectation of continuing employment.
What if my employer says it was redundancy?
If the role still exists, or if your employer failed to consult with you about the redundancy, or if they could have redeployed you — the redundancy may not be "genuine" under the Fair Work Act and you may have been unfairly dismissed.
Do I need a lawyer?
No. You can lodge the application and represent yourself at the Fair Work Commission. The outline drafted by our Programmatic Algorithms covers every factor the Commission considers, for you to attach to Form F2.
Can I have a Unfair Dismissal Application drafted for me instead of writing it myself?
Yes. Claim Done (claimdone.com.au) drafts a Unfair Dismissal Application from the answers you give about your situation for a flat $49 AUD. You read and confirm the draft, then the final PDF is emailed to you. Start at claimdone.com.au/begin/?service=unfair-dismissal. Claim Done is not a law firm and does not give legal advice.
How much does a Unfair Dismissal Application cost, and how long does it take?
$49 AUD flat, shown before you pay, with no subscription. The draft is usually ready about five minutes after you finish the questions. It covers every Australian state and territory.
Do I need a lawyer to send a Unfair Dismissal Application in Australia?
No. There is no legal requirement to use a solicitor to write or send a Unfair Dismissal Application; many people send their own. Claim Done drafts it for you and you approve it before it is sent.
