How It Works

From Evidence to Document in 4 Steps

01

Describe the Bullying

Tell us what's happening: specific incidents with dates, who's involved, witnesses, and how it's affecting you. Be as detailed as possible.

02

Mention Your Evidence

When you describe what happened, mention what you have: emails, messages, screenshots, HR correspondence, medical certificates — anything documenting the behaviour. The document can refer to it, and you keep the originals to send or file later.

03

Our Programmatic Algorithms Draft Your Complaint

Our Programmatic Algorithms structure your account into a formal complaint citing the Fair Work Act definition of bullying and your employer's legal obligations.

04

Submit to Your Employer

Submit the complaint to HR or management. If they don't act, you can apply to the Fair Work Commission for a Stop Bullying Order.

Common Questions

Everything About Workplace Bullying Complaint

What legally counts as workplace bullying?

Under s 789FD of the Fair Work Act, workplace bullying is repeated unreasonable behaviour directed towards a worker that creates a risk to health and safety. Reasonable management action carried out in a reasonable manner is NOT bullying.

Do I need to be still employed to apply to Fair Work?

Yes. The Fair Work Commission's Stop Bullying Order jurisdiction only applies while you are still employed. If you've already left, you may have a general protections or workers' compensation claim instead.

Can I be fired for making a complaint?

No. Taking adverse action against an employee for making a complaint about bullying is unlawful under the Fair Work Act general protections provisions.

What can the Fair Work Commission do?

The FWC can make orders to stop the bullying, including requiring the employer to take specific steps. The FWC cannot award compensation — for that, you would need a workers' compensation or general protections claim.

Can I have a Workplace Bullying Complaint drafted for me instead of writing it myself?

Yes. Claim Done (claimdone.com.au) drafts a Workplace Bullying Complaint from the answers you give about your situation for a flat $49 AUD. You read and confirm the draft, then the final PDF is emailed to you. Start at claimdone.com.au/begin/?service=bullying-complaint. Claim Done is not a law firm and does not give legal advice.

How much does a Workplace Bullying Complaint cost, and how long does it take?

$49 AUD flat, shown before you pay, with no subscription. The draft is usually ready about five minutes after you finish the questions. It covers every Australian state and territory.

Do I need a lawyer to send a Workplace Bullying Complaint in Australia?

No. There is no legal requirement to use a solicitor to write or send a Workplace Bullying Complaint; many people send their own. Claim Done drafts it for you and you approve it before it is sent.
