If you were hurt in a car accident on the way to or from work in the Northern Territory, two schemes can be involved: workers compensation and the motor accident scheme. Which one pays depends on the state’s rules, and getting it wrong can cost you time you do not have. Here is how it works in the NT, from the official sources.
Does workers compensation cover the drive to work in the NT?
In the NT, most journeys to and from work in a motor vehicle are excluded from workers compensation. Commutes without a vehicle, such as walking or riding a push bike, are covered (NT WorkSafe).
What about the motor accident scheme?
NT WorkSafe says a worker in a motor vehicle accident travelling to or from work can claim under the Motor Accidents Compensation (MAC) scheme. A crash during the course of your work is not covered by MAC, but may be covered by workers compensation.
The motor accident scheme in the NT: Motor Accidents Compensation (MAC) scheme, no-fault, run by TIO.
What to do now
- Report the crash to the police.
- Make a MAC claim within 6 months of the accident. A claim up to 3 years later may still be considered; after 3 years it will not be.
- MAC is a no-fault scheme.
If your employer’s scheme may also be involved:
- Tell your employer as soon as practicable.
- Get a medical certificate of capacity if you have lost income.
- Lodge the claim within six months (NT WorkSafe). Disputes go to mediation before the Work Health Court.
