If you were injured in a road accident in Western Australia as a driver, passenger, rider, cyclist or pedestrian, the scheme is: Insurance Commission of WA (ICWA): fault-based CTP, plus a no-fault scheme for catastrophic injuries. Here are the steps and time limits from the official sources.
What to do, step by step
- Report an injury crash to ICWA and the WA Police through the online crash report.
- You can claim when another driver caused the crash. ICWA says you may not be able to claim if you were totally at fault.
- Do not wait: Legal Aid WA says that if you have not lodged within three years of first becoming aware of your injury, you may be legally barred.
Were you working or on your way to work?
For a crash on an ordinary commute, the motor injury (CTP) scheme run by the Insurance Commission of WA is the usual route. Its catastrophic injuries scheme covers motor accidents from 1 July 2016 and, since 1 July 2024, workplace accidents too.
