Eviction Notice Response — Renter
Been given a termination notice, notice to vacate or notice to leave? A formal written response that checks the notice against your state's rules — grounds, evidence, notice period, form and service — and puts the landlord on notice that you'll contest it at the tribunal if it's invalid, retaliatory or unreasonable.
What this document does
- A formal written response that checks the notice against your state's rules — grounds, evidence, notice period, form and service — and puts the landlord on notice that you'll contest it at the tribunal if it's invalid, retaliatory or unreasonable.
- Records the facts that matter on paper: landlord / agent who gave the notice, notice type, dates, service method and vacate date, date and method the notice was received, date the notice says to leave.
- Puts them on formal notice, demands the conduct stop and reserves your rights if it continues.
- Cites the right Act, regulator and tribunal for your state — all eight states and territories covered.
- You review the draft first; we only send it to the other party on your say-so.
What we'll ask you
Plain-English questions, one at a time. No legal knowledge needed — if you don't know an answer exactly, your best estimate is fine.
- Who gave you the notice? The landlord or the agency name on it.
- Tell me what's going on — what led up to the notice, anything you'd raised with them beforehand (repairs, a rent increase, a complaint), and why you think it's unfair or wrong.
- What is the notice called, and what date is on it?
- When did you receive it, and how?
- What date does it say you must leave by?
- What reason does it give — and did they attach any evidence? (Or does it give no reason at all?)
- What is the rental address, when did your lease start, and is it fixed-term (end date) or periodic?
- Are you up to date with rent?
- What do you want — to stay, more time to move, or to leave with your moving costs covered?
- Anything about your household the tribunal should know? For example children at a local school, disability, health or finances.optional
- Do you have the agent's or landlord's email? We can send your response straight to them once you approve it.optional
- You approve it before it is sent
