Rent Arrears Notice to Tenant
Tenant behind on rent? Your arrears notice drafted to your state's rules — the waiting period, the notice period, the exact amount owing and what happens next. In states with an official notice form (Vic, Qld, WA, SA and NT) you get the arrears statement that goes with that form, and the form itself is still given to the tenant.
What this document does
- Your arrears notice drafted to your state's rules — the waiting period, the notice period, the exact amount owing and what happens next.
- In states with an official notice form (Vic, Qld, WA, SA and NT) you get the arrears statement that goes with that form, and the form itself is still given to the tenant.
- Records the facts that matter on paper: tenant(s), rental premises and agreement type, fixed-term or periodic (end date), date last rent payment received.
- Sets a clear deadline and spells out what happens if they ignore it.
- Cites the right Act, regulator and tribunal for your state — all eight states and territories covered.
- You review the draft first; we only send it to the other party on your say-so.
What we'll ask you
Plain-English questions, one at a time. No legal knowledge needed — if you don't know an answer exactly, your best estimate is fine.
- Who is the tenant? Full name(s) exactly as they appear on the tenancy agreement.
- Tell me what's happened — when the rent stopped, what you or your agent have already sent them (texts, emails, reminders), and anything they've said back.
- What's the rental address?
- Is the agreement fixed-term or periodic? If fixed-term, when does it end?
- What's the rent and how often is it due?
- When was the last rent payment received?
- Up to what date is the rent paid? Your rent ledger shows it.
- How much rent is owing today? Add up every missed payment — an exact figure from your ledger is best.
- What outcome do you want — the arrears paid and the tenancy to continue, or the tenancy ended and the property back?
- Have you already given the tenant the official notice form for these arrears?
- What address should the notice give for you or your agent?
- Do you have the tenant's email address? If your tenancy agreement allows email service we can send it straight to them once you approve it.optional
- You approve it before it is sent

Rent Arrears Notice — drafted to the right state law
One document, eight jurisdictions. We only ever cite the Act, regulator and tribunal for your state, so nothing from another jurisdiction bleeds into your rent arrears notice.
New South Wales
Residential Tenancies Act 2010 (NSW). Under s 88 a non-payment termination notice may only be given once rent (or water/utility charges) has remained unpaid for at least 14 days; no prior formal demand is needed.
Victoria
Residential Tenancies Act 1997 (Vic). Under s 91ZM the residential rental provider may give a notice to vacate for non-payment once the renter owes at least 14 days' rent; the notice must be on the Consumer Affairs Victoria 'Notice to vacate to renter of rented premises' form (a mandatory prescribed form), be signed, state the reason and section, and give at least 14 days' notice plus posting time.
Queensland
Residential Tenancies and Rooming Accommodation Act 2008 (Qld). Rent must be at least 7 days overdue before the lessor gives a Notice to Remedy Breach on the RTA's mandatory Form 11 under s 280, allowing at least 7 clear days (plus postal time) to pay the stated arrears.
Western Australia
Residential Tenancies Act 1987 (WA).
South Australia
Residential Tenancies Act 1995 (SA). Under s 80 a notice of termination for failure to pay rent has no effect unless rent has remained unpaid for at least 14 days before the notice is given.
Tasmania
Residential Tenancy Act 1997 (Tas). Under s 42(1)(a) the owner may serve a Notice to Vacate for failure to pay rent; the Act sets no minimum arrears period.
Australian Capital Territory
Residential Tenancies Act 1997 (ACT) and the Standard Residential Tenancy Terms in Schedule 1.
Northern Territory
Residential Tenancies Act 1999 (NT). Once rent is more than 14 days overdue the landlord serves the approved NT Consumer Affairs Form RT03 Notice to remedy unpaid rent, with a remedy date more than 7 days after the notice is given (Residential Tenancies Act 1999 (NT) s 96A(2)(d)); the landlord must apply to NTCAT no later than 14 days after that remedy date (s 96A(6)).
