Unpaid Strata Levies — Recovery Notice
Lot owner won't pay their levies? Formal final notice from the owners corporation or body corporate (or its strata manager) that itemises the arrears, applies the statutory interest or penalty, adds recovery costs, and gives the notice period your state requires before court or tribunal proceedings.
What this document does
- An itemised statement of the unpaid levies, with the period, due date and amount of each
- Interest or penalty applied at the rate you give, or the statutory rate for your state
- Your recovery costs to date set out in the notice
- The reminders and notices already sent, with their dates
- The notice period your state's strata law requires before proceedings
- Written for the owners corporation, or its strata manager as agent, for you to approve before it is sent

Strata Levy Recovery — drafted to the right state law
One document, eight jurisdictions. We only ever cite the Act, regulator and tribunal for your state, so nothing from another jurisdiction bleeds into your strata levy recovery.
New South Wales
Strata Schemes Management Act 2015 (NSW): s 83 contributions become due and payable per the notice; s 85 — a contribution not paid when due bears simple interest at 10% per annum from the due date (no interest if paid within 1 month), an unpaid contribution may be recovered as a debt.
Victoria
Owners Corporations Act 2006 (Vic): s 28 lot owners must pay fees as levied.
Queensland
Body Corporate and Community Management Act 1997 (Qld) and the applicable regulation module — for most schemes the Body Corporate and Community Management (Standard Module) Regulation 2020 (Qld).
Western Australia
Strata Titles Act 1985 (WA): s 100 — the strata company levies contributions on owners in proportion to unit entitlement.
South Australia
Strata Titles Act 1988 (SA): s 27 — the strata corporation levies contributions; it may by ordinary resolution fix interest on contributions or instalments in arrears at not more than 15% per annum (no interest on interest); an unpaid contribution and interest may be recovered as a debt from the unit holder (including a subsequent unit holder).
Tasmania
Strata Titles Act 1998 (Tas): s 83 — the body corporate levies contributions on lot owners in proportion to unit entitlement.
Australian Capital Territory
Unit Titles (Management) Act 2011 (ACT): s 78 — the owners corporation determines general fund contributions by ordinary resolution and gives written notice of the amount and due date.
Northern Territory
Unit Title Schemes Act 2009 (NT) (for schemes created under that Act) and the Unit Title Schemes (Management Modules) Regulations 2009 (NT), or the Unit Titles Act 1975 (NT) for older schemes.
