Everything About Rent Increase Objection
Can my landlord increase rent whenever they want?
No. Every state and territory limits how often rent can go up: no more than once in 12 months in each state and the Australian Capital Territory, and once in 6 months in the Northern Territory. The landlord must also give written notice before an increase (for example at least 60 days in Western Australia and 30 days in the Northern Territory). Your letter applies the rule for your state.
What is an "excessive" rent increase?
There is no fixed cap, but tribunals consider whether the increase is above market rent for comparable properties in the area, the condition of the property, and the CPI rate. An increase well above CPI with an unmaintained property is likely excessive.
Can I be evicted for objecting?
Tenancy laws protect tenants against retaliatory eviction. In New South Wales, for example, NCAT can declare a termination notice has no effect if it was given because you enforced your rights (Residential Tenancies Act 2010 (NSW) s 115). Other states have their own rules, and your letter cites the one for your state.
What about the 2026 rental reforms?
Multiple states have strengthened tenant protections in 2025-2026, including bans on no-fault evictions and extended notice periods. Our Programmatic Algorithms apply the current rules for your state.
