Neighbour Noise & Nuisance Notice
Losing sleep to a neighbour's dog, parties, air-con, power tools, music, smoke or lights? A formal notice that sets out the nuisance with your log, cites the permitted hours in your state, asks for it to stop or be kept to lawful times, and spells out the council, police, mediation and court steps that follow if it doesn't.
What this document does
- A formal notice that sets out the nuisance with your log, cites the permitted hours in your state, asks for it to stop or be kept to lawful times, and spells out the council, police, mediation and court steps that follow if it doesn't.
- Records the facts that matter on paper: neighbour / occupier, owner, agent or host to copy in, nuisance type and source, address of the source property.
- Puts them on formal notice, demands the conduct stop and reserves your rights if it continues.
- Cites the right Act, regulator and tribunal for your state — all eight states and territories covered.
- You review the draft first; we only send it to the other party on your say-so.
What we'll ask you
Plain-English questions, one at a time. No legal knowledge needed — if you don't know an answer exactly, your best estimate is fine.
- Who is the neighbour? Their name if you know it, otherwise 'The Occupier'.
- Is the property rented or a short-stay? If you know the owner, agent or host, who are they? (Optional.)optional
- What is the address of the property the noise comes from?
- Tell me how this is affecting your household day to day.
- What kind of property is it?optional
- What exactly is the nuisance — barking dog, music or parties, air-con or pool pump, power tools or construction, vehicles, smoke, lights, something else?
- Give me your log: dates, start and finish times and how long it went on, over the last few weeks at least. If you haven't kept one, list every instance you can remember with approximate times.
- What have you already done — spoken to them, sent a note, complained to council, police, the environment regulator (EPA), the building's owners corporation (strata) or the booking platform? Any reference numbers or dates?optional
- What do you want — the noise to stop altogether, or kept to certain hours (say which), or a specific fix (dog inside at night, air-con relocated, no parties after midnight)?
- Do you have an email for the neighbour, or for the owner, agent or host? We can send the notice straight to them once you approve it — otherwise you can print it and deliver it.optional
- You approve it before it is sent

Noise Nuisance Notice — drafted to the right state law
One document, eight jurisdictions. We only ever cite the Act, regulator and tribunal for your state, so nothing from another jurisdiction bleeds into your noise nuisance notice.
New South Wales
Protection of the Environment Operations Act 1997 (NSW) and Protection of the Environment Operations (Noise Control) Regulation 2026 (NSW), which commenced on 28 August 2026 and replaced the 2017 Regulation (cite it without clause numbers).
Victoria
Environment Protection Act 2017 (Vic) and Environment Protection Regulations 2021 (Vic). Under s 166 of the Act a person must not emit unreasonable noise from residential premises, and reg 114 and its table deem noise from prescribed items unreasonable if it can be heard in a habitable room of another residence during the prohibited times.
Queensland
Environmental Protection Act 1994 (Qld), Chapter 8 Part 3B (default noise standards in Division 3, ss 440R–440ZC; offence s 440Q) and the general environmental nuisance offence (s 440), enforced for residential noise by local councils (which may vary the defaults by local law) with police powers for parties.
Western Australia
Environmental Protection Act 1986 (WA) and Environmental Protection (Noise) Regulations 1997 (WA).
South Australia
Local Nuisance and Litter Control Act 2016 (SA), enforced by local councils, and the Environment Protection Act 1993 (SA) (EPA) for commercial and industrial sources.
Tasmania
Environmental Management and Pollution Control Act 1994 (Tas) and Environmental Management and Pollution Control (Noise) Regulations 2026 (Tas), enforced by local councils and Tasmania Police.
Australian Capital Territory
Environment Protection Act 1997 (ACT), Environment Protection Regulation 2005 (ACT) (Schedule 2 noise zones and standards) and the Noise Environment Protection Policy, administered by the Environment Protection Authority within Access Canberra.
Northern Territory
Summary Offences Act 1923 (NT), Waste Management and Pollution Control Act 1998 (NT) and local council by-laws, with the NT Environment Protection Authority's Noise Management Framework Guideline setting the assessment approach.
