Who can make a request under the Fair Work Act?
The Fair Work Ombudsman lists who can make a request: an employee who is pregnant, is the parent of or cares for a child of school age or younger, is a carer, has a disability, is 55 or older, is experiencing family and domestic violence, or cares for or supports a family or household member experiencing it. They need at least 12 months with the employer; a casual needs at least 12 months of regular and systematic work and a reasonable expectation that it will continue.
How long does my employer have to reply?
The Fair Work Ombudsman says an employer responds to a request in writing within 21 days. Where the Fair Work Act applies to you, the letter says so, calmly.
Can I still ask if the Fair Work Act does not apply to me?
Yes. The letter is then written as a plain, well-reasoned request, without the Fair Work Act sentences.
Does it work in my state?
Yes. The Fair Work Act is a national law, so the letter works anywhere in Australia for employees in the national workplace relations system. It is dated in your own time zone.
