A simple will is the basic document that sets out who inherits your assets when you die, who acts as your executor, and (if applicable) who you nominate as guardian for your minor children. To be valid in Australia, a will must comply with state-specific requirements under each state's Wills Act or Succession Act — typically signed in front of two independent adult witnesses, with the testator having capacity at the time.

Why this document matters

Roughly 50% of Australian adults don't have a current will. The cost is large — without a will, your estate is distributed under state intestacy rules, which often don't reflect what you actually wanted.
