Common questions

Can I really get my money back from the bank?It depends on the facts. The ePayments Code protects you where a payment was not authorised by you (for example, a scammer used your details or remote access), and banks that subscribe to the Banking Code of Practice make commitments about how they respond to scams. The letter sets out why your bank should reimburse you on your facts. If it refuses, you can complain to the Australian Financial Complaints Authority (AFCA), which is free.

What is the Scams Prevention Framework?A new Australian law, the Scams Prevention Framework Act 2025, that sets obligations for businesses in designated sectors to prevent, detect, disrupt and respond to scams. Banks, telcos and certain digital platforms were designated as the first sectors in May 2026, and most of their obligations apply from 31 March 2027. Your letter cites the Framework only where your payments were made after its obligations applied to your bank; until then, it relies on the ePayments Code and the Banking Code of Practice.

Should I report to police first?Contact your bank first and ask it to stop or recall the payment, as Scamwatch advises. Then report it at cyber.gov.au (ReportCyber). That creates an official record, and the reference number can go in your bank complaint and any AFCA complaint.
